Car in Ditch on HWY 108 leads to Impaired Charge

(ELLIOT LAKE, ON) – On December 20, 2022, at approximately 9:30 p.m. the East Algoma Ontario Provincial Police (OPP) were called to a vehicle in the ditch on Highway 108 south of Elliot Lake.

The complainant reported a male driver who looked to be impaired who had put his car in the ditch.  Police attended and spoke to the driver who emanated a strong odour of alcoholic beverage on his breath. In addition, there was an open beer can in the center console and more cans within arms reach behind the passenger seat. The driver was subsequently arrested and the vehicle was towed and impounded.

Tyler LEBRUN, 27-years-old, from Elliot Lake was charged with:

  • Operation while impaired – alcohol and drugs, contrary to section 320.14(1)(a) of the Criminal Code (CC)
  • Operation while impaired – blood alcohol concentration (80 plus), contrary to section 320.14(1)(b) of the CC
  • Careless driving, contrary to section 130(1) of the Highway Traffic Act (HTA)
  • Driving motor vehicle with open container of liquor, contrary to section 42(1)(a) of the Liquor Licence Control Act (LLCA)
  • Fail to remain, contrary to section 200(1)(a) of the HTA
  • Fail to report accident, contrary to section 199(1) of the HTA

The accused is scheduled to appear before the Ontario Court of Justice in Elliot Lake on February 6, 2023.
